Evaluation of EUROPEAN MEDIATION DIRECTIVE 2008/52

The evaluation of the Mediation Directive (2008/52) shows that overall, the Directive has provided EU added value. By raising awareness amongst national legislators of the advantages of mediation, the implementation of the Mediation Directive has had a significant impact on the legislation of several Member States. However, certain difficulties were identified concerning the functioning of the national mediation systems in practice. These difficulties are mainly related to the lack of a mediation "culture" in Member States, insufficient knowledge of how to deal with cross-border cases, the low level of awareness of mediation and the functioning of the quality control mechanisms for mediators.
